**Operated by Stuttgart Carriers Inc.**
**Effective Date:** October 23, 2026
**Last Updated:** October 23, 2026

## 1. Acceptance and Eligibility

These Terms and Conditions govern your access to and use of TinyMail.ca (“TinyMail,” “we,” “us,” or “our”), a business email hosting service operated by Stuttgart Carriers Inc., an Alberta corporation.

By purchasing, accessing, or using TinyMail services, you agree to these Terms and Conditions. You must be at least 18 years old and legally capable of entering into a binding agreement.

If you purchase or use the services on behalf of a business or organization, you represent that you are authorized to accept these Terms on its behalf.

These Terms will be made available before purchase, and customers will be asked to affirmatively accept them. TinyMail may retain records of acceptance, including the applicable version and date.

Nothing in these Terms excludes or limits any rights or remedies that cannot legally be excluded or limited under applicable law.

## 2. Services Provided

TinyMail provides managed email hosting and related services, which may include:

- Business email hosting and webmail access.
- IMAP and SMTP access through supported email clients.
- Calendar and contact services where included in the selected plan.
- Spam and malware filtering.
- Custom-domain email hosting on eligible plans.
- Domain and DNS configuration assistance where available.
- Technical support and account administration.

The number of mailboxes, storage allowance, features, and other service limits are determined by the subscription plan purchased and the details presented at checkout.

TinyMail may update or modify its services when reasonably necessary for security, maintenance, technical improvements, compatibility, or legal compliance. Where required by law, or reasonably practicable for material changes, we will provide appropriate notice.

## 3. Customer Accounts and Security

Customers must provide accurate account information and keep their account credentials confidential.

Customers are responsible for securing their passwords, maintaining appropriate access controls, and promptly notifying TinyMail of suspected unauthorized access or compromised credentials.

Customers must not share administrative access with unauthorized individuals or use another person's account without permission.

TinyMail may implement authentication controls, security monitoring, rate limits, and other reasonable measures to protect its systems and customers.

We may temporarily restrict access when reasonably necessary to investigate security incidents, prevent abuse, protect infrastructure, or comply with legal requirements.

Nothing in this section makes customers responsible for losses to the extent caused by TinyMail's own acts or omissions or otherwise allocated by applicable law.

## 4. Payments, Subscriptions, and Automatic Renewal

TinyMail uses Stripe to process payments and manage subscriptions, including recurring billing, subscription renewals, and applicable renewal notifications.

Subscriptions are billed annually in Canadian dollars (CAD), unless otherwise stated at checkout. Applicable taxes will be added to the purchase price and displayed before payment.

By purchasing a subscription, customers authorize the applicable recurring payments through Stripe and agree to the subscription price, billing frequency, automatic-renewal conditions, and other subscription terms presented during checkout.

Subscriptions automatically renew for successive annual terms unless cancelled before the next renewal, in accordance with the cancellation process and deadlines disclosed at checkout.

Stripe manages applicable subscription notifications, including renewal reminders and payment-related communications, according to the subscription configuration and notification settings in use. The timing and delivery of these communications may depend on Stripe's systems and the customer's notification settings.

Customers are responsible for maintaining valid payment information and monitoring their subscription status. If a payment fails, TinyMail may suspend or terminate service in accordance with these Terms.

Any changes to subscription pricing will be communicated before renewal, and customer consent will be obtained where required by applicable law.

Stripe processes payment information under its own terms and privacy policy. TinyMail may receive transaction and subscription information necessary to administer customer accounts, provide services, manage billing inquiries, and meet legal obligations.

Stripe's role in payment and subscription management does not relieve TinyMail of its own obligations under applicable law.

## 5. Cancellation and Refunds

Customers may cancel their subscriptions through the subscription management options made available by Stripe or by contacting **support@tinymail.ca**.

Where Stripe provides a customer billing portal, customers may use that portal to manage or cancel their subscriptions.

A cancellation ordinarily prevents the next renewal. Unless applicable law requires otherwise or TinyMail expressly agrees otherwise, service remains available until the end of the paid subscription term.

Customers are responsible for ensuring that their cancellation request has been successfully processed. Where cancellation is requested by email, TinyMail will acknowledge the request within a reasonable time and confirm the effective cancellation date.

Stripe may manage subscription cancellation processing and related notifications. Customers should follow the applicable cancellation instructions and retain any confirmation received.

Annual subscription fees are generally non-refundable for unused service or partial subscription periods. This policy does not restrict refunds, cancellations, remedies, or other rights required by applicable law, including rights that may arise from a breach of contract or a legally recognized cancellation right.

Refund requests may be submitted to **support@tinymail.ca**. Approved refunds will generally be processed through the original payment method using Stripe, where available.

Nothing in this section excludes or limits mandatory statutory rights.

## 6. Domain Ownership and DNS Responsibilities

Customers retain ownership and control of domain names they own, subject to the rights and requirements of the applicable domain registrar and registry.

Unless expressly agreed otherwise in writing, customers are responsible for:

- Registering and renewing their domain names.
- Maintaining access to their domain registrar accounts.
- Keeping domain registration information accurate.
- Maintaining the necessary DNS records for email services.
- Providing TinyMail with accurate domain information and any access or authorization necessary for configuration.
- Ensuring that they have the right to use their domain names.

TinyMail may provide technical guidance for configuring MX, SPF, DKIM, DMARC, and other relevant DNS records where supported.

Customers remain responsible for their domain registration and DNS configuration, even when TinyMail assists with setup.

TinyMail is not responsible for interruptions caused by expired domains, incorrect DNS settings, registrar failures, or changes made by customers or third parties, except to the extent caused by TinyMail's own acts or omissions or otherwise required by law.

## 7. Mailbox and Storage Limits

Each subscription is subject to the mailbox quantity, storage allowance, and other limits specified in the purchased plan.

Customers must not exceed their plan limits. If additional mailboxes or storage are required, customers may need to upgrade to a suitable plan where available.

TinyMail may notify customers when their mailbox or storage limits are reached or approached, where reasonably practicable.

Exceeding a storage limit may affect the ability to receive or store new messages. Exceeding a mailbox limit may prevent the creation of additional mailboxes.

TinyMail will not charge undisclosed overage fees. Any additional paid service or upgrade must be presented and agreed to before applicable charges are incurred.

Customers are responsible for managing their mailbox contents and maintaining independent copies of important information.

## 8. Acceptable Use

Customers must use TinyMail services lawfully and responsibly.

The following activities are prohibited:

- Sending unsolicited bulk email or operating unauthorized spam campaigns.
- Sending phishing messages, fraudulent communications, or deceptive email.
- Distributing malware, viruses, malicious links, or harmful attachments.
- Using the service for unlawful activities, harassment, threats, or abuse.
- Attempting unauthorized access to TinyMail systems or another customer's account.
- Interfering with service operations, security, or availability.
- Circumventing mailbox, storage, rate, or security limits.
- Using the service in a way that infringes third-party rights or violates applicable law.
- Reselling, redistributing, or commercially exploiting the service beyond the permissions granted by the applicable plan or a separate written agreement.

Customers are responsible for ensuring that their email use complies with applicable laws, including laws governing privacy, unsolicited commercial messages, fraud, and intellectual property.

TinyMail may investigate suspected violations and take proportionate action to protect the service, customers, and third parties.

## 9. Suspension and Termination

TinyMail may suspend or terminate a customer's account when reasonably necessary in the following circumstances:

- Payment remains overdue.
- The customer materially breaches these Terms.
- The account is used for spam, phishing, malware, fraud, or other prohibited activity.
- The account presents a material security risk.
- Suspension or termination is required by law or a valid legal order.
- Continued service creates a material risk to TinyMail's systems or other customers.

Where reasonably practicable and legally permitted, TinyMail will provide notice and an opportunity to remedy the issue before suspension or termination.

Immediate temporary suspension may be necessary where there is an urgent security threat, active abuse, a legal requirement, or a material risk of harm. Notice will be provided where appropriate and legally permitted.

For overdue payments, TinyMail may first suspend service after reasonable notice and subsequently terminate the account if the payment issue remains unresolved.

Customers may cancel their subscriptions as described in Section 5.

Suspension or termination does not eliminate payment obligations already incurred or other obligations that survive termination under these Terms.

## 10. Data Retention and Deletion

Following account termination, TinyMail will generally retain customer mailbox data for up to 30 days to allow the customer an opportunity to retrieve their information, subject to technical limitations, security requirements, and applicable law.

Customers should export or independently back up important emails, contacts, calendars, and other data before termination.

After the applicable retention period, TinyMail may delete customer mailbox data and associated account information, subject to legal obligations and legitimate retention requirements.

Backups, security logs, billing records, and other retained records may persist beyond the 30-day period where necessary for disaster recovery, security, accounting, legal compliance, or other legitimate purposes. Such information will be handled according to applicable retention practices and legal requirements.

Deletion from active systems may not result in the immediate removal of every backup copy. Residual copies may remain until removed through ordinary backup rotation and deletion processes.

The 30-day period is a general retention policy, not a guarantee that all data can be recovered throughout that period or that every copy will be permanently erased on a particular day.

## 11. Email Privacy and Confidentiality

Customer email messages and hosted content are private customer information.

TinyMail does not routinely read customer emails for general business purposes. However, systems may automatically process email content and metadata to deliver messages, synchronize mailboxes, filter spam and malware, maintain service functionality, and protect against abuse.

Limited administrative access may occur where reasonably necessary to:

- Diagnose technical issues.
- Respond to customer-authorized support requests.
- Investigate suspected abuse or security incidents.
- Maintain, secure, or restore the service.
- Comply with applicable law or valid legal process.

Access to customer content will be limited to what is reasonably necessary for the relevant purpose, subject to operational requirements and applicable law.

TinyMail does not sell customer email content to advertisers or use the contents of customer emails for advertising purposes.

Additional details about personal information handling are provided in the TinyMail Privacy Policy.

## 12. Canadian Data Residency

TinyMail is designed to provide Canadian-hosted business email services.

Customer email and related service data are intended to remain within Canada, subject to the actual arrangements of our infrastructure and service providers, applicable legal requirements, and the nature of external communications.

Messages sent to or received from external email providers may pass through systems and jurisdictions outside TinyMail's control.

Customers acknowledge that the delivery of email over the public internet involves third-party systems and networks.

TinyMail will handle personal information in accordance with its Privacy Policy and applicable Canadian privacy legislation, including applicable requirements governing service providers and transfers of personal information outside Canada.

Where legally required, TinyMail will provide appropriate notice regarding relevant processing arrangements.

## 13. Service Availability and Maintenance

TinyMail aims to provide a reliable email hosting service but does not guarantee uninterrupted availability or any particular uptime percentage.

Service interruptions may occur because of maintenance, upgrades, hardware or software failures, network problems, security incidents, third-party service failures, or circumstances beyond our reasonable control.

TinyMail will use reasonable efforts to maintain service and restore functionality following interruptions.

Where reasonably practicable, advance notice may be provided for planned maintenance that is expected to materially affect service.

Nothing in this section excludes liability or remedies that cannot legally be excluded or limits any express service commitment separately agreed to in writing.

## 14. Backups and Customer Responsibilities

Customers are responsible for maintaining independent backups of important email messages, contacts, calendars, attachments, and other business information.

TinyMail may use backup or recovery procedures to support service continuity, but unless expressly agreed in writing, TinyMail does not promise a particular backup frequency, retention period, recovery time, or recovery point.

Customers should not rely on TinyMail as their sole means of preserving business-critical information.

Nothing in this section excludes responsibility for data loss to the extent caused by TinyMail's own breach of an applicable obligation or where liability cannot legally be excluded.

## 15. Third-Party Services

TinyMail may rely on third-party providers for payment processing, hosting infrastructure, networking, software, security, support, and other operational functions.

Third-party services may be subject to separate terms, privacy policies, service limitations, and availability requirements.

Stripe processes payments and manages applicable subscription functions under its own terms and policies.

TinyMail is not responsible for independent acts or failures of third-party providers except to the extent responsibility arises under applicable law or from TinyMail's own acts or omissions.

Customers who use third-party email applications, domain registrars, or other external services are responsible for complying with the relevant third-party terms.

## 16. Intellectual Property

TinyMail and its licensors retain their respective rights in the TinyMail name, branding, website, software, documentation, and other materials, except where rights are expressly granted to customers.

Customers receive a limited, non-exclusive, non-transferable right to use the services for their intended purpose during the active subscription term.

Customers retain their rights in their own email content, domain names, and other materials, subject to applicable third-party rights.

Customers must not copy, modify, reverse engineer, distribute, or exploit TinyMail materials except as permitted by law or expressly authorized in writing.

## 17. Disclaimers

To the extent permitted by law, TinyMail provides its services on an “as available” basis and does not guarantee that the services will be uninterrupted, error-free, or compatible with every device, application, or external email provider.

TinyMail does not guarantee that every email will be delivered, received, or classified correctly, or that spam and malware filters will detect every unwanted or harmful message.

Customers remain responsible for reviewing important communications, maintaining appropriate security practices, and independently preserving critical business information.

Nothing in these Terms excludes any warranty, condition, representation, or right that applicable law prohibits us from excluding.

## 18. Limitation of Liability

To the maximum extent permitted by applicable law, neither TinyMail nor Stuttgart Carriers Inc. will be liable for indirect, incidental, special, exemplary, punitive, or consequential losses, including loss of profits, revenue, business opportunities, or anticipated savings, arising from the use of or inability to use the services.

To the maximum extent permitted by applicable law, TinyMail's aggregate liability arising out of or relating to the services or these Terms will not exceed the fees paid or payable by the customer to TinyMail for the affected services during the 12 months immediately preceding the event giving rise to the claim.

This limitation will not apply to liability that cannot lawfully be excluded or limited, including any applicable mandatory statutory rights or remedies. It does not purport to exclude liability where such exclusion is prohibited by law.

The application of any limitation will depend on the circumstances, the nature of the claim, and applicable law.

Nothing in this section excludes or limits liability for fraud or intentional misconduct where such exclusion or limitation is prohibited by law.

## 19. Indemnification

To the extent permitted by law, customers are responsible for claims, losses, or expenses arising from their unlawful use of the service, their infringement of third-party rights, or their material breach of these Terms.

Any indemnification obligation will apply only to the extent the relevant claim or loss is attributable to the customer's acts or omissions. It will not require customers to indemnify TinyMail for TinyMail's own negligence, breach, misconduct, or liability where such indemnification is prohibited by law.

TinyMail will provide reasonable notice of claims for which it seeks indemnification, where practicable, and will not unreasonably prejudice the customer's ability to respond.

## 20. Privacy and Personal Information

TinyMail handles personal information in accordance with its Privacy Policy and applicable privacy legislation.

Customers must ensure that they have the necessary authority and legal basis to submit personal information to TinyMail and to use the service to process that information.

Customers who use TinyMail to process personal information belonging to employees, clients, or other individuals remain responsible for their own legal obligations relating to that information.

Nothing in these Terms replaces or limits obligations imposed on either party by applicable privacy law.

## 21. Changes to These Terms

TinyMail may update these Terms from time to time to reflect changes in its services, operations, business practices, or legal requirements.

The current version will be published on tinymail.ca with an updated date.

Where required by law, or where a material change affects existing customers' rights or obligations, TinyMail will provide appropriate notice and obtain consent where necessary.

Changes will not override rights or remedies that have already accrued or that cannot lawfully be changed by contract.

If a customer does not agree to a material change, the customer may cancel the subscription in accordance with these Terms, subject to any applicable statutory rights.

## 22. Governing Law and Disputes

These Terms are governed by the laws of the Province of Alberta and the applicable laws of Canada.

Subject to mandatory statutory rights and any applicable jurisdictional requirements, disputes relating to these Terms or the services will be handled by the courts of Alberta.

Nothing in this section prevents a customer from exercising a right to bring a claim before another court or tribunal where applicable law permits or requires it.

The parties are encouraged to attempt to resolve disputes through good-faith communication before commencing legal proceedings, where appropriate.

## 23. General Provisions

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

A failure to enforce a provision does not constitute a waiver of the right to enforce it later.

Customers may not transfer their rights or obligations under these Terms without TinyMail's prior written consent, except where permitted by law.

TinyMail may assign its rights and obligations in connection with a corporate reorganization, merger, acquisition, or transfer of the relevant business, subject to applicable law.

These Terms, together with the applicable checkout details, Privacy Policy, and any written service-specific agreement, constitute the agreement governing the services. In the event of a conflict, mandatory law will prevail, followed by any applicable written agreement that expressly overrides these Terms.

Nothing in these Terms creates an employment, partnership, joint venture, or agency relationship between the parties.
